Terms of Service

These Terms of Service (ToS) define the rules applicable to the use of Sublify. By creating an account or using the Service, you accept these terms without reservation.
1. Definitions
- Sublify (or “the Service”): the online service for AI-powered photo enhancement, accessible at sublify.ai.
- Publisher: Gigaflux Studio (Sofiane Ben Ihaddadene), French sole proprietorship whose details are listed in the Legal Notice.
- User (or “you”): any individual or entity creating an account or using the Service.
- Credit: unit of consumption of the Service. 1 credit allows for an HD transformation; 2 credits for a 4K transformation.
- Transformation: the act of submitting a photograph to the Service to obtain an AI-enhanced version.
2. Acceptance and modification of the ToS
The User expressly accepts these ToS upon account creation. The Publisher reserves the right to modify the ToS at any time. Changes will be notified by email to registered users at least 15 days before they take effect. Continued use of the Service beyond this period constitutes acceptance of the new conditions.
3. Account creation and access to the Service
Account creation requires a valid email address and a password. The User agrees to provide accurate information and keep it up to date.
Each new account receives 3 free credits upon registration, valid without time limit. These credits allow you to discover the Service before any purchase.
The User is solely responsible for the confidentiality of their credentials. Any activity carried out from their account is presumed to be performed by them.
4. Description of the Service
Sublify allows the User to send interior or exterior photographs (rooms, facades, restaurants, breakfast rooms, etc.) to obtain an AI-enhanced version.
4.1 Faithful and Creative modes
Sublify offers two transformation modes:
- Faithful Mode: strives to preserve the photographed location, its rooms, its colors, its furniture, its tableware, and its existing decorative accessories as they appear in the source photograph (color, pattern, material, shape, and decorative details of the preserved objects). The photographic composition may be slightly adjusted for editorial-quality output, as a specialized photographer would do: subtle reframing, geometric alignment, table dressing (reorientation and alignment of elements already present), discreet duplication of elements already present to balance the composition, and addition of small generic non-personalized service items (sugar bowl, salt and pepper shakers, bread basket, butter dish, water carafe) when the corresponding embellishment options are selected. Faithful Mode does not intentionally create new rooms, new furniture, new tableware, or new decorative accessories that are not already present in the source photograph, and strives not to modify the color, pattern, material, shape, or decorative details of existing objects. Recommended for real estate and hospitality listings where visual fidelity is essential. See sections 4.5 and 4.6 below for the limits of this fidelity commitment.
- Creative Mode: applies more pronounced stylistic transformations and may take artistic liberties (colors, lighting, atmosphere). Recommended for marketing visuals, portfolios, or creative content.
⚠️ Important warning about Creative Mode: images generated in Creative Mode may take artistic liberties and may no longer faithfully reflect the reality of the location photographed. They must not be used for commercial listings on platforms such as Booking, Airbnb, Abritel, SeLoger, LeBonCoin or any other booking or rental service, where visual fidelity is required. Misleading use could engage your liability towards platforms and your customers.
For these uses, use exclusively the Faithful Mode.
4.2 Optional embellishments
The Service offers the User the option to select embellishment options (plants and flowers, cushions, candles, decorative books, wall artworks, mirrors, rugs, breakfast trays, table dressing, buffet styling, addition of pastries, fruits, juices, and other similar additions depending on the space type).
These embellishments constitute additions explicitly chosen by the User. They are not present in the source photograph and represent elements the User wishes to appear in the generated output (for example, flowers on a table where there are no flowers, or a breakfast tray on a bed where there is none).
The User is solely responsible for choosing to activate or not these embellishments and for the use of the generated images. For commercial listings on booking or rental platforms, the User is encouraged to enable only the embellishments corresponding to elements actually present in their establishment or to elements they commit to setting up, so as not to mislead their customers. Sublify merely technically executes the User's request.
4.3 Choice of space type
The Service offers the User the ability to select a space type (bedroom, bathroom, breakfast room, restaurant, facade, living room, lobby, etc.) so that Sublify applies transformations suited to that type of space.
It is the User's responsibility to select the space type that actually corresponds to the source photograph. Choosing a space type that does not match the source photograph (for example, selecting “restaurant” for a photograph of a breakfast room) may lead Sublify to apply unsuitable transformations, or even to modify the visual identity of the location to make it resemble the requested space type (layout change, addition of elements characteristic of the chosen type).
Sublify cannot be held responsible for the results obtained when an unsuitable space type is selected. The User is encouraged to verify that the chosen space type matches their photograph before each transformation.
4.4 Technical limits
- Maximum size per uploaded photograph: 25 MB
- Accepted formats: JPEG, PNG, WebP
- No daily or monthly limit on transformations (within available credits)
4.5 Fidelity limitations tied to source photograph quality
Faithful Mode relies on visible information in the source photograph to preserve the location's identity. Some areas of the source photograph may, however, contain too little visual information for Sublify to reliably preserve them, notably:
- Overexposed areas (for example, an exterior view behind a window when the photograph is taken from inside a dark room) where details are drowned in light
- Underexposed or very dark areas where details cannot be distinguished
- Blurry, out-of-frame, or partially obstructed areas
- Very low-resolution areas (small elements far away, lost in image compression)
In such cases, Sublify may complete these areas with plausible visual elements (clear sky, open view, etc.) that do not necessarily reflect the location's reality. For commercial listings (real estate, hospitality, rental), it is the User's responsibility to provide a source photograph of sufficient quality and with appropriate exposure, so that elements they wish to preserve (notably exterior views, facades visible through windows, etc.) are clearly distinguishable in the source photograph. Sublify cannot be held responsible for an inaccurate representation of elements that were not clearly visible in the source photograph.
4.6 Technical limitations inherent to generative AI
Sublify relies on generative artificial intelligence models. Despite the fidelity commitments described in section 4.1 and the technical constraints applied to the model, occasional deviations may occur even when the source photograph is of good quality and properly exposed. By way of non-exhaustive example, Faithful Mode may, in rare cases, unintentionally modify or replace:
- Elements visible through windows (buildings, trees, outdoor landscapes)
- Furniture details (pattern, finish, material) despite the preservation commitment
- Decorative elements present in the source photograph
- Lighting or colorimetry of the scene
These deviations stem from the statistical and non-deterministic nature of generative AI models, and cannot be entirely eliminated despite the technical measures implemented by Sublify. It is the User's responsibility to verify the obtained result before any use, and in particular before any publication in a commercial listing, and to refrain from publishing a result that would not faithfully correspond to the actual location. The User may launch a new generation (consuming a new credit) if a deviation is observed; each generation produces a different and independent result. Sublify cannot be held responsible for any harm resulting from the User's publication of an unverified result.
5. Pricing and payment
5.1 Credit packs
Sublify is offered as one-time purchase credit packs (no subscription):

Prices are inclusive of taxes (VAT not applicable, art. 293 B of the French Tax Code — French micro-entreprise status). All payments are made in euros (EUR) via the Stripe provider.
Purchased credits never expire and remain available in your account as long as it is active.

5.3 Image storage
- Free users (who have never purchased a pack): 30 days
- Users who have purchased a pack: 90 days per generated image
Beyond this period, images are automatically deleted from our servers. Users are invited to download their images within these timeframes if they wish to keep them.
6. Right of withdrawal
In accordance with Article L. 221-18 of the French Consumer Code, the consumer User has a period of 14 days from the purchase to exercise their right of withdrawal, without having to justify their decision.
Express waiver of the right of withdrawal for consumed credits — In accordance with Article L. 221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not delivered on a tangible medium whose execution has begun after the consumer's prior express agreement and express waiver of their right of withdrawal.
When purchasing a credit pack, the User expressly consents to the immediate availability of credits in their account and waives their right of withdrawal for credits actually used within 14 days of purchase.
The right of withdrawal remains applicable for unused credits at the date of the withdrawal request, within 14 days following the purchase. Refunds will be made pro rata to the unconsumed credits.
To exercise this right, contact us at contact@sublify.ai with your Stripe order number and the mention “withdrawal”. The refund will be made within 14 days using the same payment method as the original purchase.
Beyond 14 days, no refund can be made, including for unused credits.
7. Intellectual property of images
7.1 Source images
The User warrants that they have all the necessary rights over the photographs they submit to the Service (copyright, image rights, authorizations from persons or properties depicted). The User is solely responsible for the content they upload.
7.2 Generated images
The User remains the exclusive owner of images generated from their original photographs. Sublify grants them an unlimited commercial usage right on these images, without additional royalty.
Sublify does not use users' photographs to train AI models, build training datasets, or sell them to third parties.
8. Prohibited uses
The User agrees not to use the Service for:
- Uploading illegal, violent, hateful, pornographic content, or content infringing on human dignity
- Uploading images of persons without their consent
- Uploading images protected by copyrights the User does not hold
- Using the Service for commercial deception (particularly in Creative Mode on platforms requiring visual fidelity)
- Attempting to circumvent the technical limits of the Service or its security systems
- Performing scraping, mass data extraction, or unauthorized automation
- Reselling, sublicensing or redistributing the Service or its features to third parties without prior written agreement
- Creating multiple accounts to multiply free credits or circumvent Service limits
- Using the Service for direct competitive purposes (creating a similar service inspired by Sublify)
In case of breach, the Publisher reserves the right to suspend or delete the User's account without notice or refund of credits.
9. Service availability
The Publisher endeavors to keep the Service accessible 24/7, but cannot guarantee total availability. The Service may be temporarily interrupted for maintenance operations, updates, or in case of force majeure (technical incident, cyberattack, third-party provider failure, etc.).
The Publisher is not responsible for unavailability or slowdowns attributable to the third-party services used (Vercel, Supabase, Replicate, Stripe, etc.) or to the quality of the User's internet connection.
10. Liability limitations
Sublify is an AI-powered image enhancement service. The generated results depend on the quality of the source photograph and the capabilities of the AI model used. The result may vary from one generation to another.
The Publisher cannot be held responsible for:
- The subjective quality of generated images if they do not match User expectations
- The use the User makes of generated images (particularly in case of misleading use in Creative Mode)
- Commercial consequences of using images on third-party platforms
- Indirect damages (loss of revenue, loss of opportunity, damage to reputation)
- Incidents related to third-party services (Stripe, Vercel, Replicate, etc.)
In any case, the Publisher's liability is limited to the total amount paid by the User over the past 12 months, in accordance with standard industry contractual practices.
11. Suspension and termination
The User may terminate their account at any time from the account settings page. Unused credits will be lost upon termination, except for a refund request exercised under the right of withdrawal (see article 6).
The Publisher may suspend or terminate a User's account in case of breach of these ToS, without notice or refund.
12. Personal data
The processing of personal data is governed by our Privacy Policy, which is an integral part of these ToS.
13. Cookies
The use of cookies is detailed in our Cookie Policy.
14. Governing law and jurisdiction
These ToS are governed by French law. In case of dispute and failing amicable agreement, French courts shall have exclusive jurisdiction.
In accordance with Article L. 612-1 of the French Consumer Code, the consumer User may use the consumer mediation service free of charge: the European online dispute resolution platform is accessible at ec.europa.eu/consumers/odr.
